Holiday Rental Booking Terms

All bookings are made with Samui Holiday Villa Rental Partnership, Ltd. acting as agents on behalf of the owners of the properties featured in the company website. The payment of any deposit for the rental rate shall be taken as confirmation of acceptance of the following terms and conditions.

When we (“Samui Holiday Villa Rental Partnership, Ltd.”) receive your (“the customer's”) enquiry we will confirm availability of the villa(s), price of villa rental and amount of deposit required to confirm the booking. Bookings are on a 'first-come, first-served' basis and are for a minimum of three (3) nights. We reserve the right to decline a booking without giving any reason. Rates do not include telephone, car rental, food, soft drinks and/or liquor, personal items and expenses due to any other third parties, and any excessive cleaning required upon departure (such as upholstery or rug shampooing, etc) or replacement of breakages. An initial deposit of 30% of the villa rental must be paid to confirm a booking, unless otherwise specified. Before a contract is signed we reserve the right to modify the agreed prices. No contract exists until we receive your deposit. If your deposit is not received in five working days we reserve the right to cancel the booking. If the booking is cancelled, cancellation charges will occur in accordance with the section of this contract entitled “CANCELLATION”.

We only accept payment by international transfer to our Thai bank account as it is the cheapest and safest way to transfer funds abroad. Nowadays, funds can be sent internationally through online banking with most major banks. Please ensure that the funds arrive in our account free from bank charges and remittance by instructing your bank that you wish to pay all transfer charges both on your side and to the overseas bank.
Payment of your balance must be paid at least 30 days before your arrival at the villa, unless otherwise specified. If we do not receive the balance by the due date, we reserve the right to cancel the booking and cancellation charges will apply. If the booking is confirmed within 30 days of the arrival date, the full balance should be paid at the time of booking, unless otherwise specified.

If you want to cancel the booking or any part of the booking, we must be notified by email. The cancellation will take effect the day we receive your email notifying us of the cancellation. Cancellation charges: 30 days or more before arrival date: Deposit payment is forfeited. Within 30 days of arrival date: All rental payments are forfeited.
These cancellation charges also apply if we cancel a booking due to late payment of the balance. If the dates of the booking need to be changed or amended, this may be treated as a cancellation of the original booking and cancellation charges may or may not apply. Any change to the original booking is subject to our approval.

Check-in time is generally 3pm and check-out time is generally 12am though many villa owners will be at least slightly flexible on this. (early arrival and late departure will depend upon availability of the villas at the time of arrival or departure). The client is responsible for informing the correct arrival details (including flight number) when an airport transfer is part of the SHVR service.

It is very unlikely that we will need to cancel a booking, though it does occasionally happen and we will advise you at the earliest possible date. If we cannot provide you with your chosen villa, we reserve the right to cancel the booking. For example: If the villa is damaged or there is very heavy construction nearby, we will try to find you another property. If this is not possible we will cancel the booking and give a full refund for the booking (less any bank costs).

The number of people staying at the property, including children, must not exceed the maximum capacity indicated in the property description or elsewhere, except in the case of infants (under two years old), or unless specifically authorized. If we find the number of people exceeds the maximum capacity, we reserve the right to ask the extra person or person(s) to pay an additional charge or to vacate the villa. We regret that no pets are allowed on the properties.

A security deposit is usually paid when you check-in at the villa, though for some villas it is payable to us with the payment of the balance. This is to cover the cost of any damage or breakages during the rental period of the Villas or their contents. It may also be used to cover the cost of the use of telephones and other services. This amount will be returned to you at the time of departure, less any such costs.

The entire party should be covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). We are held harmless by you and your party against all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental. We can not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of our control such as civil disturbances, fires, floods, severe weather, acts of God, acts of Government etc. By acceptance of this contract it is assumed by us that this requirement has and will be complied with in full.

Each Villa has differences in standard, quality and finish and there are differences in style and decor. Property descriptions as provided by us, on the website and elsewhere, are made in good faith. We accept no responsibility for any modifications to the villas which are not mentioned on the website or elsewhere. We, the villa owner and/or the local representative can not be held liable for the breakdown of the supply of water, or electricity, or internet connection nor of swimming pool filtration systems, though we will try our absolute best to arrange for any such problems to be solved quickly. If there are any problems during the rental period, which could not be solved by dealing directly with the local villa staff, contact us or our local representative immediately and we will try our very best to rectify the situation. It should be understood that infrastructure, local standards and conditions are often less developed in a remote resort location than in more urban environments. We will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems beyond our control. Any complaints must be notified to us within 24 hours of the problem occuring, and must then be given in writing to us before departure. Should a problem remain unsolved please make a complaint in writing to SHVR within 14 days of the completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement this may result in the loss of all rights to compensation. No complaint will be considered if made after the departure date or if not acknowledged by us, the villa owner or the local representative.

The person paying the deposit for the villa rental is responsible for the correct and appropriate behaviour of the guests staying at the Villa(s). Should any member of the party behave inappropriately we, the villa owner or the local representative may ask the offending guest or guests to vacate the villa immediately. This will be treated as a cancellation of the original booking and no refund can be claimed from us, the villa owners or the local representative.

The services of some staff may be included at the villas (ie maids, handyman). Additional services such as those of baby sitters and/or drivers can be sourced in advance or on site upon request, although such services cannot be guaranteed and depend on availability. We recommend Guests provide as much notice as possible, especially during peak holiday seasons and we shall try to assist. We or the local representative can assume no liability for such contracted staff. The rates for these services will be provided in advance and shall be paid as incurred.

Linen and towels are provided at the Villas. These are normally changed every three days. If you require more frequent changes there may be extra charges. Limited laundry facilities may exist on site and charges are made per item. Outside services are also available for a small service charge and must be paid at the time incurred or by the time of departure.

Security safes are provided in most villas. It is strongly recommended that they are used to store valuable items such as passports, cash, traveller's cheques, mobile phone, cameras etc. Any valuables left at the property are the guests’ sole responsibility. Neither we nor the owners nor the staff can be held responsible for any loss or damage of personal property. It is advised for Guests to ensure that all doors and windows remain locked at night and when the villa is unoccupied, to avoid any temptation.

As part of this agreement Guests are required to take due care when residing at the villas and be especially watchful of children playing in the gardens, near the entrance from the main road; near or in the pool or jacuzzi, on the beach, or in the sea. Guests are not permitted to enter the villas when wet from swimming as the floors can be slippery. Damage or injury arising as a result shall not be the responsibility of us, the villa owners or the local representative in any way whatsoever.

By sending a booking deposit, the customer has agreed to abide by the above conditions and agreed to the application of the above Terms and Conditions to their booking with Samui Holiday Villa Rental Partnership, Ltd..
